TERMS OF USE FORACORRE USERS

General Terms

These Terms of Use (including all other terms, policies, notices, guidelines, and forms referenced herein or otherwise available on the Platform or by hyperlink) (“Terms”) govern your access and use of the information service platform (“Platform”) through our websites and mobile applications known as Acorre Community (together referred to as “Applications”) provided by Acorre Sdn. Bhd. (or referred to as “Acorre”, “we” or “us”), a company incorporated in Malaysia.

The “Services” we provide or make available include (a) the Platform, and (b) the services provided by the Platform and/or by Acorre and/or made available through the Platform. Any new features added to the Services are also subject to these Terms. These Terms govern your use of Services provided by Acorre Community.

The word “Merchants”, “Services Providers”, “Sellers” or “Acorre Business Users” carries the same meaning and is referring to the Acorre Business Users who sells or markets certain products or services to the consumers in Acorre Community.

Please carefully read through and understand these terms before accessing or using the Applications. These terms, whether stated or otherwise referenced herein, set forth rights and obligations and constitute a legal agreement between Acorre and you.

By using or accessing the Platform, you hereby expressly affirm and declare that:

you have read and understood these Terms

you will comply with these Terms (including all other terms, policies, notices, guidelines, and forms referenced herein);

you are at the age of legal majority in your place of residence and otherwise legally competent to enter into contracts;

you have the authority to enter into these Terms personally and, if applicable, on behalf of any organization and/or entity on whose behalf you have enrolled for use of the Platform and to bind such organization and/or entity to these Terms; and

you agree that all agreements, notices, announcements, and any communications may be provided to you electronically and such communications shall be deemed to have satisfied any legal requirements for communications to be made in writing.

If you do not agree with the Terms, please do not access or use or continue using the Application, or the Services.

Acorre Community is an application which links you as a user (“Users”) to a variety of merchants (“Merchants”) and service providers (“Service Providers”) for you to place order for products or goods and/or to obtain services (“Products and/or Services”) of your choice.

When you place an order from our Merchants and/or Service Providers through the Platform (“Order”), Acorre Community acts as a venue or platform connecting the Merchants and/or Service Providers to the Users. Upon placing an Order, any delivery of Order to you will be handled by the Merchants and not Acorre.

Acorre does not provide, own or control any of the Products and/or Services that you may access to through our Platform which is made available by Merchants and/or Service Providers. The Products and/or Services are owned, controlled or made available by the Merchants and/or Service Providers. The Merchants and/or Service Providers are responsible for the Products supplied and for all Services provided. The Merchants and/or Service Providers’ terms and privacy policies apply to each of your Order, and for each Order placed, you are deemed to have agreed and understood those terms. Your interaction with the Merchants and/or Service Providers accessed through our Platform is at your own risk, and Acorre is not responsible should there be any complaint, dispute, inaccuracy, problems and/or issue with your Order, the Products and/or Services received.

In these Terms, “Applicable Law” means, unless stated otherwise, the applicable Malaysian laws, rules, regulations, directives, regulatory guidance, policies and/or orders governing all Products and/or Services provided hereunder.

Acorre reserves the right to amend, vary, change or modify these Terms (including any additional terms and conditions or policies, which are published on the Platform and incorporated into these Terms) at any time. We encourage you to review these Terms regularly to stay informed and updated about our practices. The changes of the Term are effective when the revised Terms are published unless we notify you otherwise. You will be deemed to have agreed to the amended Terms (whether or not reviewed by you) by your continued use of the Platform following the date on which the amended Terms are published.

Users

The Platform may be used by natural persons who have attained the age of legal majority in your place of residence and otherwise legally competent to enter into contracts.

Users below the age of legal majority in your place of residence must obtain consent from parent(s) or legal guardian(s), who by accepting these Terms shall agree to take responsibility for your action and be liable for any charges associated with your use of the Platform and/or purchase of Goods or Services. If you do not have consent from your parent(s) or legal guardian(s), you must stop using/accessing the Platform or our Services immediately.

Disclaimer

All pictures, photos and images of the products shown on the Platform are uploaded by the Merchants or Service Providers and are for illustration purpose only. Acorre does not own or have control over such pictures, photos and images and shall not be held liable for any claim, losses, damages and/or demand arising thereof. Some pictures, photos and images may be outdated and/or different from the actual Goods.

Acorre Community is merely a platform for you to obtain and/or procure Products and/or Services provided by Merchants and/or Service Providers. Acorre Community shall not in any way be responsible for the acts and/or omissions of any Merchants and/or Service Providers. Merchants and/or Service Providers shall bear all liabilities in relation to such Goods and Services.

Use of the Platform and Acorre Community Account

2.1 You will need to register for an Acorre Community account in order for you to use the application. For the purposes of account registration, we will ask you to provide your personal information including but not limited to a valid email address, a mobile phone number and a unique password (login credentials). Your unique password and login credentials should not be shared with anyone and you agree to keep it secret at all times. You are solely responsible for keeping your password safe. Save for cases of fraud or abuse not attributable to you, you accept that all activities and orders placed under your Acorre Community account are your sole responsibility.

2.2 It is your responsibility to ensure that the information given by you, including but not limited to your intended delivery address and contact information, is complete, accurate and truthful for the purpose of processing of the Order by Merchants and/or Service Providers. Acorre shall not be held responsible and/or liable for Order that encounters delivery issues due to incomplete, incorrect or missing information provided by you.

2.3 Acorre reserves the right to restrict, limit, suspend, terminate and/or delete your account if we reasonably believe that:

someone other than you are using your Acorre Community account;

there is unwanted or illegal access to your Acorre Community account; or

where you are suspected or discovered to have been involved in any activity or conduct that is in breach of these Terms, our policies and guidelines, or involved in activity or conduct which we deem in our sole discretion to be an abuse and/or misuse of the Platform.

Restrictions – Activities Prohibited on the Platform

3.1 The following is a non-exhaustive list of prohibited activities –

sending and/or posting spam, duplicative, unwanted and/or unsolicited messages, contents, remarks and/or comments;

sending and/or posting messages, contents, remarks and/or comments as determined by Acorre Community and/or pursuant to local community standards, to be unlawful, obscene, harmful, defamatory, threatening, harassing, abusive, slanderous, hateful, racially or ethnically offensive, unverified and/or embarrassing;

using Acorre Community and/or the Platform for unlawful purpose and/or any purpose which is in violation of local, state, or federal laws or regulations, including any false, deceptive, misleading, or fraudulent purpose;

sending and/or posting messages, contents, remarks and/or comments which is copied, not genuine, stolen and/or infringes the intellectual property right, privacy rights, publicity rights, trade secret rights, or any other rights of any party;

sending and/or posting messages, contents, remarks and/or comments that constitutes cyber-bullying, as determined by Acorre in its sole discretion;

sending and/or posting messages, contents, remarks and/or comments that depicts any dangerous, life-threatening, or otherwise risky behaviour;

sending and/or posting messages, contents, remarks and/or comments which contains personal details of a third party, including but not limited to names, telephone numbers, addresses, contact details and/or Registered National Identity Number without consent;

sending and/or posting messages, contents, remarks and/or comments which contains URLs or web addresses to external websites or any form of HTML or programming code;

harvesting, collecting and/or extracting information from Acorre Community and/or our platform without consent for commercial or unpermitted purposes;

impersonating any person or entity when sending and/or posting messages, contents, remarks and/or comments;

misrepresenting your affiliation with any person or entity;

allowing any other person or entity to use your identification for when sending and/or posting messages, contents, remarks and/or comments;

engaging in any conduct or activities which will undermine the integrity or affect the performance of the Platform and/or Acorre Community;

engaging in any conduct which may restrict, interfere, disturb, disrupt or inhibit the usage of this Acorre Community and/or Platform by any other person, or which, in the sole discretion of Acorre Community, exposes Acorre Community or any of its customers, suppliers, or any other parties to any liability or detriment of any type;

engaging in any conduct which could tarnish and/or damage our reputation or bring us into disrepute;

engaging in any conduct which may circumvent the proper operation, running or use of the Platform and/or Acorre Community;

data-mining; or

encouraging other people to engage in any prohibited activities as described herein.

3.2 In the event, any user is believed to be, engaging in any prohibited activities, Acorre may in its sole discretion, take any of the following actions:

investigate any allegation and/or complaint in relation to content which does not conform to these Terms and take appropriate action determine in its sole discretion to remove or request the removal of the content;

delete and/or remove the relevant content which is abusive, illegal, or disruptive, or that otherwise fails to conform with these Terms;

suspend, delete and/or terminate a user’s access to the Platform or their Acorre Community account upon any breach of these Terms;

monitor, edit and/or disclose to third party any content published on the Platform; and

take appropriate legal action against the user without further notice.

Intellectual Property

Acorre shall exclusively own, whether registered or unregistered, all right, title and interest of all trademarks, logos, images, brand elements, service marks and/or any other related intellectual property rights in and to the Platform, as well as the Services (collectively referred to as “Intellectual Property”). Unless you have obtained our prior express written consent and/or authorization, you may not use, copy, reproduce, republish, upload, post, transmit, distribute, or modify these Intellectual Property owned by Acorre in any way. The use of the Intellectual Property on any other website not approved by us is strictly prohibited. Acorre will enforce its intellectual property rights to the fullest extent of the law, including criminal prosecution. Acorre neither warrants nor represents that your use of materials displayed on the Platform will not infringe rights of third parties not owned by or affiliated with Acorre. The use of any materials on the Platform is at your own risk.

Store by Acorre Merchant

The purchases of Products or Services from Merchants or Service Providers on the Platform are subject to these Terms. Additionally, you agree to comply with any and all the guidelines, notices, operating rules, policies and instructions, which may be provided from time to time pertaining to the purchase of such Products or Services and which are incorporated into and form a part of these Terms.

All the Products and Services’ prices and delivery charges, if necessary, will be fixed solely by the Merchants and Service Providers. Acorre does not in anyway involve in or determine the price offered by any Merchants and Service Providers.

We reserve the right, but are not obligated, to restrict or limit the sales of Merchants’ Product or Services to any person, geographic region or jurisdiction.

The Merchants and/or Service Providers shall not offer for sale certain goods, or restricted items to you (e.g. Alcohol, Tobacco, etc.). Any offer for any Products or Services made on the Platform is void when the sale of such Products or provision of such Services is prohibited by law. Acorre shall not be held responsible for any Products and/or Services and/or contents on any of the Merchant’s and/or Service Provider’s store which appears on the Platform which is illegal or prohibited by the law.

Restrictions on Products

Some of the products offered by Merchants on our Platform are subject to restrictions and can only be listed under certain conditions (“Restricted Goods”), depending on the Applicable Law.. These restrictions include minimum age requirements for alcohol/alcoholic products and any other goods that we reserve the right not to deliver to you based on the relevant statutory requirements of the time being in force. By placing an order for Restricted Goods, you confirm that you meet the legal requirements to purchase them.

6.2 In the event you are in breach of any applicable restrictions on Products, you hereby agree that you will be solely liable and responsible for any legal consequences, and you further agree to indemnify, defend and hold harmless Acorre, the Merchants or Service Providers on the Platform from and against any and all claims, actions, proceedings and all related liabilities, damages, settlements, penalties, fines, costs and expenses (including legal expenses) incurred by Acorre, the Merchants or Service Providers in relation to the breach of representation, warranty and/or law in respective jurisdiction.

Service Information

Acorre Community merely offers a platform that hosts content, including prices, images and other information, made available and published by Merchants and Service Providers as well as content provided by users, such as reviews, ratings and other information (and together with the merchants and service provider content, collectively referred to as the “Content”). Acorre is in no way responsible or liable for the accuracy, quality, completeness, reliability, timeliness or trustworthiness of the Content, and Acorre has no influence over the Content. In particular, we do not guarantee the existence, availability, quality, safety or legality of items or services advertised; the truth or accuracy of Seller’s content or listings; the ability of Sellers to sell the items or services; or if the products or services fit its description or your intended purposes. We also do not guarantee that the prices displayed on the Platform will be updated in real time, therefore the price displayed by a Seller may not correspond to that displayed on our Platform. Ratings displayed on this Platform are intended as general guidelines, and we do not guarantee the accuracy of the ratings or of any User Content.

Orders and Appointment

After placing an order with Merchants or set an appointment with Service Providers through Acorre Community, you will receive a notification from Acorre containing the order and delivery details or the appointment details.

Special Instructions – the Merchants and Service Providers (as the case may be) will use its reasonable endeavor to comply with your special instructions for an order. However, in some cases where this is not feasible, possible or commercially reasonable, the Merchants and Service Providers reserve the right to proceed to prepare the order in accordance with standard operating procedures. As a facilitating platform for the Order, Acorre shall not be held responsible if an order does not conform to your special instructions or requests.

Please note that the Merchants and Service Providers may impose additional terms and conditions on orders or services. By placing an order, you are deemed to have agreed and/or accepted the additional terms and conditions so imposed.

Once you select a Merchant or Service Provider, you will be taken to its menu page for you to select and add your selected products into the cart or to set appointment date for your selected service;

For product purchase, you are required to provide the exact delivery address in order for the Platform to notify the Merchant of your delivery address.

Placing an order:-

To complete an order, please click ‘Checkout’ and follow the onscreen instructions thereafter. You are required to review and confirm that all the information you provide, including the amounts, delivery details, personal details, or appointment date is true, accurate and complete before confirming the Order. An Order is successfully placed when you receive a notification containing your order details from Acorre.

Once an Order is successfully placed, you will be contacted by the the Merchants or Service Providers directly for payment arrangement without Acorre’s involvement.

Cancelling an Order

8.7.1 At this moment, Acorre does not support any cancellation request by consumer. You will have to directly contact the Merchants or Service Providers to attend to your cancellation request.

Merchants and Service Providers reserve the right to cancel any order or appointment booking.

Modification of Order, Appointment or Booking

8.8.1 You will have to directly contact the Merchants and Service Providers for any modification of order, appointment or booking.

Acorre may suspend, deactivate or terminate your Acorre Community account in its sole discretion if it reasonably suspects or detects fraudulent behaviour or activity associated with your Acorre Community account and/or with your Order.

Delivery by Merchants

Acorre does not offer any delivery services for any Products. All delivery activities and rates are being fixed and/or decided solely by Merchants without Acorre’s intervention or involvement.

You are responsible for providing the true, complete and accurate delivery details such as the recipient’s name, address, contact number, map location (GPS) and any other delivery details as required when placing an Order in order for the Merchants to make the necessary delivery arrangement. In this case and by placing an Order, you agree to allow Acorre and/or the Merchants to track your exact location in order to estimate routes distance between the recipient’s location and Merchants. Further, by placing an Order, you are deemed to have read, understood and agreed to be bound by the terms and conditions imposed on the use of Google Maps.

Acorre is not liable for any unsuccessful delivery, loss of monies, contamination of Products or any issues relating to the delivery of Products. Any communications between you and Merchants regarding the delivery/services will not be linked to Acorre.

9.4 You shall not request the delivery/services of any of the following items:

items classified as hazardous material, dangerous goods, illegal, prohibited or restricted articles by any government or regulatory agencies

radio-active, incendiary, corrosive or flammable substances, hazardous chemicals, explosives, firearms or parts thereof and ammunition, firecrackers, cyanides, precipitates

flammable and unsafe items (including lighter and power banks)

gold and silver ore, bullion, precious metals and stones, jewelry, semi-precious stones including commercial carbons or industrial diamonds

perishable items

valuable items including cash, currency of any nationality, securities, coupons, stamps, negotiable instruments in bearer form, cashier’s cheques, travelers’ cheques

counterfeit goods, illegally reproduced or pirated items (e.g., CDs, DVDs)

passports, NRIC, birth certificate, credit/debit/ATM cards and other valuable documents

antiques, works of art

lottery tickets and gambling devices

livestock, fish, insects, animals, plants and plant material

human corpses, organs or body parts, blood, urine and other liquid diagnostic specimens

hazardous or bio-medical waste

pornographic materials

alcoholic beverages or any intoxicant, infectious item or narcotics and psychotropic substances

any other items that are illegal, hazardous, dangerous, or otherwise restricted or prohibited under any statute or law or regulation for transportation

fragile items without proper packaging and protection

any item which exceeded the maximum allowable dimension and weigh

any item that are restricted, prohibited and/or not eligible for delivery based on the Applicable Law

In the event that you request delivery of any illegal or unlawful or prohibited items (such as the items mentioned in Clause 9.4 above) or items which may otherwise be prohibited or restricted under any Applicable Law in respective jurisdiction, Merchants reserve the right to refuse or reject such Orders and may take such steps as may be necessary to report the same to the law enforcement authorities.

In the event, during transit of your delivery item(s) from pick-up location to drop-off location or while providing the delivery Service, if police or other law enforcement agencies request or make a demand to view your item(s) for verification, Merchants or the assigned delivery personnel shall have the right to display your item(s) to such law enforcement agencies. You agree to fully assist and provide all necessary information to us in the event of any regulatory investigations.

You shall be solely liable for any loss, damage, or contamination relating to the delivery item(s) whether or not caused directly or indirectly by you or the recipient of the delivery item(s) or any person acting as an agent or representative for or on behalf of you or the recipient.

Merchant shall have the right to cancel or not proceed with your delivery request in the event your request does not fulfil certain criteria, including but not limited to, the drop-off location falling outside of the delivery zone offered on the Platform, you are uncontactable by phone or other means of communication, the recipient of the delivery item(s) is uncontactable or unavailable physically when the delivery personnel arrives at the drop-off location, or you do not provide sufficient information or authorization at the time of delivery.

Pick-Up

Where available, you will have the option of collecting your order in-person directly from the Merchant’s designated pick up location instead of having the order delivered to you. Your confirmation notification will indicate the time for you to pick-up the order (“Collection Time”). The Merchant will prepare the Order by the Collection Time. In some cases, a reasonable delay may be expected. The Merchant agrees to hold the Order for you at the Merchant’s premises for no more than a reasonable period of twenty (20) minutes from the Collection Time and shall not be obliged to provide the Order to you if you fail to pick-up your Order within the Holding Time.

In the event of unreasonable delay in pick-up attributable to you, you bear the risk of any damage or loss of products or any deterioration in quality or change in condition of the products (e.g. changes in the temperature fit for consumption). In this case, you shall not be entitled to a replacement, refund or replacement of the products. You are responsible for inspecting the products/order during pick-up of your Order and shall report any issues and/or defects to the Merchants before leaving the Merchant’s premises.

Prices and Payments

Prices quoted on the Platform shall be displayed in merchant’s local currency and may subject to applicable tax. You accept that prices and offers on the Platform may differ or vary from the prices and offers offered by our Merchants elsewhere (including but not limited to their own websites, mobile applications, or at their outlets).

Prices and additional charges (including but not limited to delivery and service fees) indicated on the Platform are as at the time of each order and may be subject to change by Merchants.

A breakdown of the prices and additional charges (including but not limited to delivery and service fees) will be displayed before checkout. When you place an order, you agree to all amounts, additional charges and the final ‘Total’ amount which is displayed to you.

Payment shall be made to the Merchant and/or Service Provider either directly or through whichever payment method offered by the Merchant and/or Service Provider. Acorre, which only serves as a venue to connect users to Merchant and/or Service Provider, does not in any way involve in the payment collection process between you and the Merchant and/or Service Provider and does not have an obligation to intervene should there be any dispute arises between the User and the Merchant and/or Service Provider.

Disclaimer of Warranties and Limitation of Liabilities

Representations and Warranties

You acknowledge and agree that the content on the Platform and any related service(s) is provided to you on an “as is” and “as available” basis, and that your use of or reliance upon the Platform and any content, goods, products or services accessed or obtained thereby is at your sole risk and discretion.

While Acorre makes reasonable efforts to ensure the provision of the Platform and the Services we offer, are available and up-to-date at all times, we do not warrant, represent or guarantee that the Platform shall be provided in a manner which is secured, timely, uninterrupted, error-free, free of technical difficulties, defects or viruses. Please expect temporary interruptions of the Platform due to scheduled or regular system maintenance work, downtimes attributable to internet or electronic communications or events of force majeure.

Limitation of Liability

Unless otherwise stated, and to the fullest extent permitted by law, Acorre Community (which shall include its employees, directors, agents, representatives, affiliates and parent company) exclude all liability (whether arising in contract, in negligence or otherwise) for loss or damage which you or any third party may incur in connection with our Platform, our Services, and any website linked to our Platform and any content or material posted on it. Your exclusive remedy with respect to your use of the Platform is to discontinue your use of the Platform. The Acorre Community entities, their agents, representatives, and service providers shall not be liable for any indirect, special, incidental, consequential, or exemplary damages arising from your use of the Platform or for any other claim related in any way to your use of the Platform. These exclusions for indirect, special, consequential, and exemplary damages include, without limitation, damages for lost profits, lost data, loss of goodwill, work stoppage, computer failure, or malfunction, or any other commercial damages or losses, even if the Acorre Community entities, their agents, representatives, and service providers have been advised of the possibility thereof and regardless of the legal or equitable theory upon which the claim is based.

Merchant’s and/or Service Provider’s representations

Acorre shall neither be liable for any representation or warranty made by the Merchants and/or Service Providers nor actions or omissions caused by the Merchant and/or Service Provider in regard to provision of the Goods and where delivery applies to your Order. Acorre Community does not assume any liability for the quantity, quality, condition or other representations of the Goods and/or services provided by Merchant and/or Service Provider respectively or guarantee the accuracy or completeness of the information (including menu information, photographs and images of the Goods) displayed on the Merchant’s and/or Service Provider’s listing/offering on the Platform.

Merchant’s Liability

Merchants are solely responsible for the preparation, condition and quality of Goods sold to you. In cases of Delivery of Goods, Merchants are responsible for delivery of the Goods and/or Orders. Acorre Community shall not be responsible or liable for any loss, damage, expense, cost or fees arising from your contractual relationship with the Merchants and Service Providers. Nothing in these Terms shall exclude Merchant’s liability for death or personal injury arising from Merchant’s gross negligence or willful misconduct.

Personal Data (Personal Information) Protection

By registering an Acorre Community account and/or using the Platform, you agree and consent to Acorre and any of its affiliate companies collecting, using, processing and disclosing your Personal Data in accordance with these Terms and as further described in our Privacy Policy. Our Privacy Policy is accessible via the links on our Platform.

You further acknowledge that in the course of your use of Acorre Community services and/or the Platform, Acorre Community may disclose Personal Data of other individuals to you and you represent and warrant that you will only use such Personal Data for the purpose of which it was disclosed to you for, and not for any other purposes.

Indemnity

You agree that you shall indemnify and hold Acorre, its affiliates, officers, directors, members, employees, agents harmless from and against any and all claims, damages, liabilities, losses and/or costs (including legal fees and/or costs) arising out of –

your use of the Platform, services and/or Acorre Community;

breach or violation of these Terms; and/or

infringement by you or other third party using your account or identity to obtain the Goods and Services.

15.2 You further agree that you will use your best endeavour to co-operate and assist us in possible defences should the need arise.

Third Party Links and Websites

The Platform may contain links to other third-party products, websites, contents, services and offers and by clicking on these third-party links, you agree to do so entirely at your own risk. You acknowledge that these third-party links, products, websites and services are not owned or controlled by us. We do not control or endorse these third-party websites or links and shall not be responsible for the content, functionality, security, services, privacy policies, or other practices of these third party linked pages. We accept no liability or responsibility for any errors, omissions, defamation, libel, slander, obscenity, misrepresentation, inaccuracy, losses or damages which may be suffered by you in relation to your access and use of these third-party links and websites.

Termination

Acorre has the right to terminate, suspend or delete your account and your access to or use of the Platform, including any delivery service provide to you in respect of an Order, for any reason, including, without limitation, if Acorre, in its sole discretion, considers your use to be unacceptable, or in the event of any breach by you of the Terms. Acorre may, but shall be under no obligation to, provide you a warning prior to termination of your use of the Platform and we shall not be required to compensate you for termination.

Amendments

Acorre may amend these Terms at any time in its sole discretion, and the amended Terms shall be effective immediately upon posting. It is your responsibility to check the Terms regularly. If you do not agree with the amended Terms, whether in whole or in part, you must stop using the Platform immediately. By continue using our Platform, you are deemed to have understood, agreed and accepted our Terms.

Severability

If any provision of these Terms is found to be invalid or unenforceable by any court having competent jurisdiction, the invalidity or unenforceability of such provision/term shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. No waiver of any provision in these Terms shall be deemed a further or continuing waiver of such provision or any other provision.

Governing Law

These Terms shall be governed by and construed in accordance with Malaysian law. In the event any dispute arising out of or in connection with these Terms cannot be resolved via Acorre Support Centre, the Courts of Malaysia shall have exclusive jurisdiction in respect of any dispute arising out of or in connection with these Terms.

Prevailing Language

In the event of a dispute as to the Terms, the English version shall prevail in case of any inconsistencies with translated versions.

PERSONAL DATA PROTECTION AND PRIVACY POLICY

In compliance with the laws of Malaysia, in particular the Personal Data Protection Act 2010 (“the Act”) and its regulations, this notice is issued to all our valued clients and/or prospective clients. This notice will inform you of your rights with regards to your personal data that has been and/or will be, collected and processed by us.

Acorre Sdn. Bhd. (referred to as “Acorre”,”our”, “us” or “we”) is committed to protecting your personal data and privacy.

1. What data or information do we collect

In processing activities conducted on our Platform, we will need to collect, use, disclose and/or process data and information about yourself, your organization and/or your employees (“Personal Data”) to enable such functions in Clause 2.

The Personal Data may include but not limited to personal details such as name, Identification Card number, date of birth, gender, race, religion, contact details, residential address, office address, email address, occupation, designation, bank account details, marital status, information as to mental and physical health or other such data as necessary for the performance of our services to you.

If you provide us Personal Data about another person (“Data Subject”), you confirm that the other data subject has appointed you to act on his/her behalf and has agreed that you can:

Give consent on his/her behalf to the processing of his or her personal information;

Receive in his/her behalf any data protection notices; and

Warrant that you have obtained his/her consent for us to store his/her information.

2. Why do we collect Personal Data

Acorre however note that certain Personal Data provided by you does not require consent from the data subject as it falls within the exceptions provided by data protect legislations.

The Personal Data collected is relevant for the following purposes (“Purposes”) –

To provide our services on to you;

To communicate with you includes but not limited to responding your inquiries, complaints or resolving disputes;

To able any delivery of e-newsletter or promotional marketing materials of such services whether present or future to you;

for internal user’s management, record keeping, audit, risk management and security purposes;

for creating and maintaining a database where we have a legitimate common interest;

to able any research and development of our product, services and events;

to comply with any legal or regulatory requirements in relation to our provision of services;

to make disclosures under the requirements of any Applicable Law, by-law, regulation, court order, direction, guideline, code, circular applicable to us; and

for or in connection with all other purposes necessary or incidental to our operations and purposes necessary for or related to any of the above Purposes.

The failure to provide such Personal Data may result in us being unable to provide you with the services requested or to carry out the Purposes.

3. Disclosure of Personal Data

We may share your Personal Data with:

Merchants and/or service providers for the purposes of performing service or supplying products;

service providers who help with our business operations (such but not limited to accountant, auditor, insurer information, professional entities and technology service provider);

any person to whom we are compelled or required to do so under law or in response to a competent regulatory authority or government agency or industry regulators;

third parties (including those overseas) who provide data processing services, any credit reference agencies or, in the event of default; and

any other person that may relevant to our business and functions or to carry our any of the Purposes.

We take every measure to provide a comparable level of protection for personal data should the information be processed by Merchant and/or Service Provider or other entities. Acorre is committed to complying with the laws of Malaysia, in particular Personal Data Protection Act 2010, in particular, its policies as well as corresponding guidelines and orders.

Transfer of Personal Data Overseas

In providing our services to you, it may be necessary for us to forward Personal Data to relevant overseas third-party service providers, under conditions of confidentiality and as allowed by our data protection laws.

Change to this Policy

We reserve the right to change, modify or update this Personal Data Protection & Privacy from time to time without prior notice.

Right to Access and Modifications

You have the right to request access to your Personal Data held by us and to correct it to ensure that it is accurate, complete and up-to-date.
